Educative, Inc. doing business as Fenzo ("Fenzo," "we," "us," or "our") operates the fenzo.ai website and related services (the "Service").This Privacy Policy informs you of our policies regarding the collection, use and disclosure of Personal Information when you use our Service.We will not use or share your information with anyone except as described in this Privacy Policy.We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, capitalized terms used in this Privacy Policy have the same meanings as in our Terms of Service .


Information Collection, Use and Retention

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, and profile information ("Personal Information"). In addition, we track your progress on particular courses, your interactions with interactive widgets, your AI Mentor and AI Evaluator session activity, and your course generation history to help you pick up where you left off and improve your learning experience.We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your purchase orders, and improving our products and services. If you do not provide Personal Information when requested, you may not be able to benefit from the Service if that information is necessary to provide you with the Service or if we are legally required to collect it.

User Content

We collect content you submit to the Service, including:

  • Course generation prompts and topic descriptions
  • Uploaded documents (PDFs, test papers, notes, images) for context-aware learning
  • Responses to assessments, quizzes, and interactive widgets
  • Free-text inputs to AI Mentor and AI Evaluator Feedback, reviews, and ratings

Payment Information

When you purchase a Subscription Plan, our third-party payment processor collects your payment card information, billing address, and related billing details. Fenzo does not directly store your full payment card number. Payment details you provide will be encrypted using secure sockets layer (SSL) technology before they are submitted over the internet. Our payment processor is only permitted to use such data to process your purchase.

Data Retention

We take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we need to retain certain information as required by law. Specifically:

  • Account information: Retained while your account is active and for 30 days after account deletion.
  • Learning data (progress, scores, knowledge graph): Retained while your account is active. Deleted within 30 days of account deletion unless required by law or enterprise agreement.
  • AI interaction data (Mentor, Evaluator sessions): Retained for up to 12 months in identifiable form for service improvement, then anonymized.
  • Uploaded documents: Retained for the duration of the associated course, then deleted within 90 days.
  • Payment records: Retained as required by applicable tax and financial regulations (typically 7 years).
  • Anonymized and aggregated data: May be retained indefinitely as it is no longer linked to any individual.We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes.

Organization Data

If you are using the Service through your organization (employer, school, etc.), your organization will be able to see information about you including, without limitation, your name, your progress on courses, and information about your activities using the Service. Contact your organization's administrator if you have any questions about what information they can see and what they are able to do with it.

Log Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device ("Log Data").This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third party service providers have their own privacy policies addressing how they use such information.

Location Information

We may use and store information about your general location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service. You can enable or disable location services when you use our Service at any time, through your device settings.

AI and Machine Learning Data Practices

This section provides specific transparency about how your data is used in relation to our AI systems.

AI Model Training

We may use anonymized and aggregated interaction data to improve our AI models, including:

  • Course generation quality (improving the structure, accuracy, and pedagogical quality of generated courses)
  • AI Mentor and AI Evaluator response quality
  • `Widget interaction patterns (understanding which interactive elements are most effective for learning)

Anonymization

Before using any data for AI model training, we remove or obscure personally identifiable information. Individual prompts, responses, and interactions are aggregated and anonymized so that they cannot be traced back to specific users.

Uploaded Content

Documents you upload for context-aware learning are used solely to generate your personalized course. We do not use the content of your uploaded documents to train our AI models. Uploaded documents are retained for the duration necessary to deliver the service and are deleted according to our data retention schedule.

Enterprise Data

For Enterprise customers: if we introduce enterprise plans in the future, we will not use any Enterprise customer data (including user interactions, uploaded content, or custom course content) for AI model training, unless the Enterprise customer has explicitly opted in via their enterprise agreement.

AI Model Providers

To power AI Features, we transmit User Content (such as course generation prompts and AI Mentor/Evaluator interactions) to third-party AI model providers. This transmission is necessary to generate courses and provide AI-powered interactions. We require our AI model providers to:

  • Process your data solely for the purpose of providing the AI service
  • Not use your data to train their own models (where contractually available)
  • Maintain appropriate security measures

Opting Out

If you wish to opt out of having your anonymized interaction data used for AI model improvement, you may do so by contacting us at privacy@fenzo.ai. Opting out will not affect your use of the Service but may limit our ability to improve AI quality for your specific use patterns.

On What Legal Grounds We Process Personal Information

If you are located in the European Economic Area ("EEA"), Switzerland or the United Kingdom ("UK"), we only process your Personal Information based on a valid legal ground, including when:

  • Consent. You have consented to the use of your Personal Information, for example when you consent to transactional emails, newsletters, marketing or promotional materials and other information by creating an account on our Service.
  • Contract. We need your Personal Information to provide you with the Service, including responding to your inquiries.
  • Legal obligation. We have a legal obligation to use your Personal Information, for example to comply with tax and accounting obligations.
  • Legitimate interest. We or a third party may have a legitimate interest in using your Personal Information, in particular for product development, AI model improvement, and internal analytics purposes, and otherwise to improve the safety, security, and performance of the Service. We only rely on our or a third party's legitimate interests to process your Personal Information when these interests are not overridden by your rights and interests.

Do Not Track Disclosure

We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

We use cookies, local storage, and similar technologies to:

  • Maintain your session and authentication state
  • Remember your preferences and settings
  • Analyze usage patterns and improve the Service
  • Deliver relevant communications

Service Providers

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used.These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose. Such third party service providers fall into the following categories: payment processors, cloud hosting and infrastructure providers, AI model providers, analytics service providers, customer support tools, and email delivery providers.

Communications

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

Compliance With Laws

We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

Business Transaction

If Educative, Inc. is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information becomes subject to a different privacy policy.

Security

The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure. These measures include:

  • Encryption of data in transit (TLS 1.2+) and at rest (AES-256)
  • Access controls and authentication requirements for internal systems
  • Regular security assessments and vulnerability testing

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.

International Transfer

The data that we collect from you will primarily be stored in the United States.If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there. You may exercise those rights by emailing Fenzo at privacy@fenzo.ai. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain Personal Information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

If you are using the Service through your organization, the organization is the Data Controller for purposes of the GDPR and the UK GDPR. You must exercise these rights by contacting your organization's administrator in charge of the Service.

United States Residents

Certain U.S. states, including California, Virginia, Colorado, Connecticut and Utah, have passed privacy laws for consumers (including, without limitation the California Consumer Privacy Act of 2018 ("CCPA")). If you are a consumer in a state where such privacy laws have been passed, you may have additional rights under such laws regarding how we use and share your Personal Information. We may provide Personal Data to have our Service Providers, as defined by the CCPA, perform services for us.

Children's Privacy

Fenzo is available to users aged 13 and older. We do not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us at privacy@fenzo.ai.

Users Aged 13 to 17

Users aged 13-17 may create their own accounts with the consent of a parent or legal guardian. We collect the same types of information as for adult users. We do not knowingly share the personal information of users under 18 with third parties for marketing purposes. We do not serve behavioral advertising to users under 18.

Educational Institution Use

When Fenzo is used in a school or educational institution context, the institution may act in a supervisory capacity for students aged 13-17. Institutions using Fenzo for students should ensure appropriate parental consent and notification is in place per their own policies. Fenzo will enter into agreements with educational institutions as needed to comply with the Family Educational Rights and Privacy Act (FERPA) and applicable state student privacy laws.

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes To This Privacy Policy
